    VintageWorn – Terms & Conditions

    Welcome to VintageWorn (“we,” “our,” “us”). By accessing vintageworn.com (“Site”) or purchasing any product or service from VintageWorn, you (“buyer,” “customer,” “you”) agree to the following Terms & Conditions. If you do not agree, please discontinue use of the Site.

    These terms govern all purchases, consignment engagements, sourcing agreements, servicing work, and interactions with VintageWorn.

     

    0. Payment for Products and/or Services

    a. Accepted Payment Methods

    VintageWorn accepts the following forms of payment:

    • Bank wire transfer
    • Zelle (info@vintageworn.com) up to $8000
    • Other approved methods at our discretion

    We do not accept credit card chargebacks, disputes, or reversals once a payment has been made.

    b. Reserving a Watch (Deposit Required)

    If you would like to reserve a watch, you may email us with the specific watch in question and submit a $2,500 depositvia Zelle to info@vintageworn.com.

    Once the deposit is received:

    • The watch will be placed on hold exclusively for you
    • We will issue an invoice within 48 hours of receiving the deposit
    • The remaining balance must be paid by bank wire transfer

    c. Payment Deadline for Remaining Balance

    The remaining balance (wire transfer) must be delivered to our account within 72 hours of receiving the invoice.

    If full payment is not received within this 72-hour window:

    • Your $2,500 deposit is forfeited, without exception
    • The watch may be immediately relisted or sold to another buyer
    • No refunds, credits, or transfers of deposit will be provided

    d. Refunds on Deposits

    All deposits — including reservation deposits, sourcing deposits, or other payments made to hold a watch — are non-refundable under all circumstances unless explicitly stated otherwise in writing.

    e. Payment for Sourcing, Consignment, and Services

    All payments related to sourcing engagements, consignment work, or watch servicing are due before work is completed or before any watch is returned or shipped.

    Funds must fully clear before the release of any product or serviced item.

    1. No Affiliation With Rolex or Any Watch Manufacturer

    VintageWorn is an independent seller of pre-owned watches.
    We are not authorized, affiliated, sponsored, or endorsed by:

    • Rolex SA
    • Rolex USA
    • Tudor
    • Patek Philippe
    • Audemars Piguet
    • Omega
    • Or any other watch brand

    All trademarks belong to their respective owners.

    2. Product Authenticity & Description

    VintageWorn guarantees authenticity to the best of our professional knowledge.

    Because vintage watches are decades old:

    • Condition descriptions are subjective
    • Watches may show aging, patina, service replacements, discoloration, or unknown service history
    • We cannot guarantee originality of every part
    • Service-era or period-correct replacement parts may be present

    Purchasing from us means accepting all inherent characteristics of vintage watches.

    3. Mechanical Performance & Water Resistance

    3.1 Mechanical Limitations

    Unless stated otherwise, we do not guarantee:

    • COSC accuracy
    • Long-term timing performance
    • Power reserve duration
    • Chronograph precision
    • Future servicing needs

    Vintage watches vary in performance and may require occasional service.

    3.2 Water Resistance

    NO vintage watch sold by VintageWorn is water-resistant under ANY circumstance.

    Assume every watch must be kept away from:

    • Water
    • Moisture
    • Rain
    • Steam
    • Sweat or humidity
    • Showers
    • Pools
    • Saunas / steam rooms

    VintageWorn is not liable for moisture or water damage.

    4. 6-Month Limited Movement Warranty

    We provide a 6-month limited movement warranty covering:

    • Complete mechanical failure
    • Movement not running
    • Time deviation beyond ±60 sec/day

    Not covered:

    • Water/moisture damage
    • Impacts or drops
    • Magnetization
    • Cosmetic components
    • Third-party tampering
    • Natural vintage variability

    Warranty repairs must be completed by our approved watchmaker.

    5. Sales & Return Policy

    5.1 All Sales Are Final

    Except as outlined, all sales are final.

    Returns ONLY accepted if:

    1. Watch is proven not authentic
    2. Watch is grossly misrepresented

    5.2 Buyer’s Remorse Returns (7 Days, 15% Fee)

    If you simply do not like the watch:

    • Return within 7 days of delivery
    • 15% restocking fee applies
    • Buyer covers all shipping
    • Watch must be in identical, unworn condition

    We reserve the right to deny remorse returns for any reason whatsoever but not limited to if wear or tampering is evident.

    5.3 Return Procedure

    1. Email info@vintageworn.com
    2. Wait for written approval
    3. Ship within 48 hours, fully insured
    4. Inspection occurs within 48 hours of receipt
    5. Refund issued if eligible

    6. Deposits, Offers & Make-an-Offer Terms

    • All deposits are non-refundable
    • Accepted offers are binding
    • Payments must be completed on time
    • Cancelled or unpaid offers may result in deposit forfeiture
    • Once accepted, the watch is removed from inventory

    7. Watch Sourcing / Concierge Acquisition

    7.1 Deposit

    non-refundable 30% deposit is required to begin sourcing.

    7.2 Payment

    • 30% upfront
    • Remaining balance due in full before shipping

    7.3 Watches Over $50,000

    We may require:

    • Higher non-refundable deposit (up to 50%)
    • Or full prepayment

    7.4 No Cancellation

    Once sourcing begins, it cannot be canceled.

    7.5 Sourced Watch Returns

    Subject to the standard return rules.

    8. Selling Your Watch to VintageWorn (Buybacks & Trade-ins)

    • Evaluated case by case
    • No guaranteed buyback or trade value
    • Valuation based solely on current market conditions
    • Original purchase price has no relevance
    • All offers are discretionary and non-binding until agreed in writing

    9. Consignment Policy

    9.1 Market Valuation

    We determine a recommended listing price based on the market, condition, and comparables.

    9.2 Photography & Listing

    We will:

    • Professionally photograph the watch
    • Write accurate descriptions
    • Market across our sales channels

    9.3 Consignment Fee

    Our fee is 15% of the final sale price, non-refundable.

    9.4 Accuracy Requirement

    Consignor must provide accurate information about:

    • Authenticity
    • Originality
    • Service history
    • Condition

    9.5 Misrepresentation Consequences

    If a buyer later discovers misrepresentation:

    1. Consignor is fully responsible for remedying the issue (refunds, repairs, shipping, financial loss).
    2. VintageWorn retains the full 15% consignment fee, without exception.
    3. Consignor indemnifies VintageWorn from all related claims.

    9.6 Payout

    Proceeds (minus 15%) paid once funds clear.

    9.7 Retrieval

    Consignor pays for return shipping and insurance if they remove an unsold watch.

    10. Servicing & Repair Policy

    10.1 Shipping Responsibility

    The customer must ship watches to us:

    • Fully insured
    • With tracking
    • At their own risk

    We are not liable for inbound transit loss/damage.

    10.2 Estimates

    We provide a quote after evaluation.
    Work begins only with written approval.

    10.3 Payment

    Must be paid before return shipment.
    Watches unpaid after 90 days may accrue fees or be considered abandoned as permitted by law.

    10.4 Service Warranty

    Any service warranty applies only to the work performed and excludes:

    • Water damage
    • Impact damage
    • Third-party tampering
    • Natural aging

    11. Right to Refuse Service or Sales

    VintageWorn reserves the absolute right, at our sole discretion, to refuse service, refuse sales, cancel orders, or discontinue interactions with any customer, including (but not limited to) customers who:

    • Do not comply with these Terms & Conditions
    • Exhibit rude, abusive, hostile, or unreasonable behavior
    • Present fraudulent risk or unethical conduct
    • Provide misleading or incomplete information
    • Attempt to negotiate in bad faith
    • Interfere with business operations

    We may refuse or terminate business relationships without obligation to provide a reason.

    Refunds (if applicable) will follow our stated policies.

    12. Anti-Defamation & Online Conduct Policy

    By purchasing from VintageWorn, you agree not to:

    • Publish false, defamatory, misleading, or unsubstantiated claims
    • Make slanderous or libelous statements
    • Spread misinformation
    • Post hostile or malicious content intended to harm our business
    • Engage in public harassment, disparagement, or character attacks
    • Post unprofessional, unfounded, or deceptive opinions presented as fact

    This applies to all platforms, including:

    • Social media
    • Forums
    • Review sites
    • YouTube
    • Blogs
    • Messaging apps

    Violations of this policy may result in legal action, including but not limited to:

    • Civil claims for defamation
    • Business interference claims
    • Damages and attorney fees
    • Mandatory removal of defamatory content

    You agree that VintageWorn may seek legal remedies for reputational harm.

    13. Shipping, Insurance & Risk of Loss

    • We use reputable carriers
    • Insurance is available and may be required
    • If buyer declines insurance, buyer assumes all transit risk
    • Risk transfers to buyer once the carrier receives the package

    14. Taxes, Duties & Import Fees

    Buyer is responsible for all duties, VAT, taxes, and customs charges.

    15. Intellectual Property

    All photos, descriptions, and content are the property of VintageWorn.
    No reproduction without written consent.

    16. Limitation of Liability

    VintageWorn is not liable for:

    • Subjective expectations
    • Third-party opinions
    • Market value fluctuations
    • Post-warranty repairs
    • Incidental or punitive damages
    • Emotional distress claims

    Your sole remedy is the return rights stated above.

    17. Binding Arbitration Agreement (No Lawsuits)

    17.1 Mandatory Arbitration

    All disputes must be resolved exclusively through binding arbitration, not court.

    You waive:

    • Right to sue VintageWorn
    • Right to a trial by jury
    • Right to pursue claims against owners personally

    17.2 No Personal Liability

    Claims must be against the business entity only.

    17.3 No Class Actions

    No class, collective, or group actions.

    17.4 Governing Law

    Arbitration in [Insert State & County], under the laws of [Insert State].

    17.5 Survival

    This section survives all transactions.

    18. Updates to Terms

    VintageWorn may update or modify these Terms at any time.
    Use of the Site constitutes acceptance of the updated Terms.
